I guess that full investigation included a review of Pocatello City Code 9.32.020: DISCHARGE OF FIREARMS PROHIBITED:

It is unlawful for any person to discharge firearms of any kind or description;

Oh, yeah, here it is:

provided, however, that this shall not apply to police officers or other persons licensed to carry firearms, in the discharge of their duties...

Was he discharging his duties--or just his gun?
